DUI; Breathalyzer Refusal, 2nd Offense – REDUCED TO RECKLESS DRIVING WITH NO LOSS OF LICENSE

1. Criminal Charges: Driving Under the Influence; Breathalyzer Refusal 2^nd Offense

Police Report:  Smithfield Police respond to a minor motor vehicle accident involving 3 cars.  Upon arrival all operators are out of their cars and are separated and questioned by police.  While questioning Client, they observe an odor of alcohol, bloodshot and watery eyes and mumbled speech.  Client refuses to take any tests and requests medical attention.  He is taken by rescue to the hospital where he refuses a blood draw.

Driving under the Influence:                                       REDUCED TO RECKLESS DRIVING WITH NO LOSS OF LICENSE

Breathalyzer Refusal 2^nd Offense:                               DISMISSED WITH NO LOSS OF LICENSE
