Criminal Charges: Driving Under the Influence less than .15

Police Report: RI State Police received numerous 911 calls regarding an “erratic driver” on 95S in the area of Exeter. Police set up a position and observe Client’s vehicle pass their position at a high rate of speed, estimated at 85MPH. Troopers get behind Client’s vehicle and observe it to weaving from lane to lane without the use of a turn signal. Troopers stop Client’s vehicle and approach from both sides. Both Troopers indicate they smell an odor of alcohol, watery/bloodshot eyes and mumbled speech. Client admits to drinking and then fails 3 field-sobriety tests. At the barracks, Client agrees to take the Breathalyzer test and registers a .115 and .123

Criminal Case Result:

• DRIVING UNDER THE INFLUENCE less than .15: REDUCED TO RECKLESS DRIVING WITH NO LOSS OF LICENSE
