Criminal Charges: Driving Under the Influence; Breathalyzer Refusal

Police Report: West Greenwich Police receive a BOLO for an erratic operator being followed by East Greenwich PD but refusing to stop. WG PD catches up to Client’s vehicle in their town and “box in” Client’s car at an intersection preventing her from continuing. Police approach the car and observe a mild odor of alcohol about her person, but completely dialated pupils. Client takes and fails 3 field-sobriety tests. Client also takes the preliminary breath test at the scene registering a .021. Suspecting lient to be under the influence of narcotics they request a blood sample at the hospital and Client refuses to allow the blood draw.

Criminal Case Result:

DRIVING UNDER THE INFLUENCE: REDUCED TO RECKLESS DRIVING WITH NO LOSS OF LICENSE
BREATHALYZER REFUSAL: DISMISSED WITH NO LOSS OF LICENSE.
