Police Report: Driving Under the Influence; Breathalyzer Refusal

Police Report: Pawtucket Police observe Client’s vehicle traveling in excess of the speed limit and weaving in and out of the breakdown lane. Police stop and approach Client and immediately detect an odor of alcohol, see bloodshot eyes and say Client was speaking with mumbled speech. Client exited the vehicle and attempted the 3 field-sobriety tests but failed all 3. Client admitted to having a “couple drinks” with dinner earlier in the evening.

Criminal Case Result:

• DRIVING UNDER THE INFLUENCE: DISMISSED AND EXPUNGED OFF RECORD
• BREATHALYZER REFUSAL: DISMISSED WITH NO LOSS OF LICENSE
