November 2013: Driving Under the Influence; Breathalyzer Refusal
An anonymous caller driving behind Client’s vehicle calls the South Kingstown Police to report she is behind a drunk driver. The caller follows Client, relaying their location to the police until Client is eventually stopped. Police approach Client’s vehicle and immediately observe an open container of alcohol in the center console and the strong odor of alcohol coming from Client’s breath. Client exits the vehicle and stumbles to the back of his car where he takes and fails 3 field sobriety tests. Client admits to the police that “he had a few”.

- Driving Under the Influence: REDUCED TO RECKLESS DRIVING WITH NO LOSS OF LICENSE
- Breathalyzer Refusal: DISMISSED WITH NO LOSS OF LICENSE
